Gates told Justice of the Peace Nancy Sabo that he was vigorously opposed to anyone else feeding his horses. Despite his objections, Sabo ordered the independent feedings while Gates charges arc pending. The sheriffs department has received several complaints since 1993 about the condition of Gates' horses and pigs, but none of the complaints were forwarded to the county attorneys office until recently, McKittrick said. She added that she may file an additional animal cruelty charge against Gates regarding his numerous pigs. But one good days feed could not erase Burlingtons concerns for the horses welfare.

During the trios walk through Gates pasture -with Gates looking on Burlington identified one alleged problem after another. Burlington pointed out what appeared to be emaciated horses, some, allegedly, with damaged hooves. Others had distended bellies which Burlington suggested were a sign of worms. One good thing, at least, was that the horses appeared to have access to running water and some shade. Keel said.

During his initial appearance Wednesday, Gates denied neglecting his horses, claiming he COURTS STEVENSVILLE- Ethyl Keel got her first look at 33 allegedly neglected horses Thursday afternoon, and, in her opinion, the sight wasnt a pretty one. What can I say?" the manager of the Bitterroot Humane Association said. I'm just at a loss the weight loss, the worms in the belly and the feet are just atrocious. Ravalli County Sheriff Deputy Scott Burlington gave Keel and Deputy County Attorney Jamie McKittrick a tour of a dry pasture Thursday where nearly three dozen allegedly underfed horses ambled listlessly in the hot sun. The tour came a day after the horses owner, Joseph Sylvester Gates, 78, pleaded innocent to 33 counts of animal cruelty in Ravalli County Justice Court.

A court order issued Wednesday allowed volunteers to come feed the horses daily, and Burlington brought Keel and McKittrick out to assess the feeding situation. Burlington had been to Gates house and ranch northeast of Stevensville several times before to investigate complaints of animal abuse, most recently on Sunday. What he saw Thursday surprised him. Hes dumped tons of hay out here, Burlington said, motioning his hands over the closely-cropped grass. In fact, Burlington found enough hay on the pasture that he decided Keel, who had come out specifically to feed the horses, didnt need to.
